With the Communiqué Amending the “Communiqué on the Implementation of the Regulation on the Qualifications of Tourism Facilities (2019/1)” published in the Official Gazette dated 08.06.2023 and numbered 32215 by the Ministry of Culture and Tourism, the following article was added to the said communiqué:
“(5) In applications by the Ministry, the certificate required to be obtained under the Law for the facilities determined by the Ministry and the documents required by the Ministry may be requested. In addition, if music is used in the accommodation facilities, a document showing that the music license certificate has been obtained from the relevant federations operating under the Law on Intellectual and Artistic Works dated 5/12/1951 and numbered 5846 is attached to the application.’’
The following provisional article has also been added to the same communiqué;
“Time period for certified facilities to obtain a music license certificate
PROVISIONAL ARTICLE 3- (1) Accommodation facilities certified before the effective date of this article (including those with simple accommodation tourism management certificate) are obliged to submit the document regarding the music licence specified in the fifth paragraph of Article 4 to the Ministry until 1/10/2023. Otherwise, action shall be taken against these facilities within the scope of the Law.”
In this context; Accommodation facilities that broadcast music in common and open spaces are obliged to obtain a music licence certificate and notify the Ministry by 01.10.2023 within the framework of Law No. 5846 on Intellectual and Artistic Works.
The Owners of Works in the Music Industry (MSF) and the Federation of Related Rights in the Music Industry (MÜZFED) are authorised by the Ministry to issue the said licence document, and the accommodation facilities will be able to submit their applications for the Music Licence Certificate via the website www.otellisanslama.org. The scope of the music licence, the annual licence fees and information on the licensee’s accommodation facilities are announced on the aforementioned website. In addition, annual license tariff fees determined for 2023 are attached.
It has been stated that under the Tourism Incentive Law No. 2634, action will be taken against accommodation establishments found to be operating without a valid music licence.
